LEGISLATIVE DECREE NO. 196 OF 30 JUNE 2003 TITLE II – RIGHTS OF THE DATA SUBJECT ARTICLE 7 (Right of Access to Personal Data and Other Rights)

 

The data subject has the right to obtain confirmation as to whether or not personal data concerning him or her exist, even if not yet recorded, and to receive such data in an intelligible form.

 

The data subject has the right to obtain information regarding:

a) the origin of the personal data;
b) the purposes and methods of processing;
c) the logic applied in the event of processing carried out with the aid of electronic instruments;
d) the identification details of the Data Controller, data processors, and the representative designated pursuant to Article 5, paragraph 2;
e) the entities or categories of entities to whom the personal data may be communicated or who may become aware of such data in their capacity as designated representatives within the State territory, data processors, or persons in charge of processing.

 

The data subject has the right to obtain:

a) the updating, rectification or, where interested therein, integration of the data;
b) the erasure, anonymization, or blocking of data processed unlawfully, including data whose retention is unnecessary for the purposes for which they were collected or subsequently processed;
c) certification that the operations referred to in points (a) and (b) have been notified, including their content, to those to whom the data were communicated or disclosed, unless this requirement proves impossible or involves a manifestly disproportionate effort compared to the protected right.

 

The data subject has the right to object, in whole or in part:

a) on legitimate grounds, to the processing of personal data concerning him or her, even if relevant to the purpose of collection;
